3. What SMARTFIND Does Not Do

SMARTFIND is not:

  • SCHUFA;
  • an official credit bureau;
  • a financial advisor;
  • a legal advisor;
  • a real estate agency;
  • a landlord;
  • a broker;
  • a guarantor;
  • a government authority;
  • a provider of official credit reports.
SMARTFIND does not guarantee that you will get an apartment, that a landlord will approve your application, that a listing will be available, or that any report or document will be accepted by landlords, agencies, platforms, or third parties.

4. Informational Use Only

All information, recommendations, AI outputs, scores, reports, summaries, checklists, and texts provided by SMARTFIND are for informational purposes only.

You are responsible for reviewing all materials before using them and for making your own decisions regarding rental applications, document sharing, communication with landlords, and entering into rental agreements.

5. Rental Trust Report / Alternative Trust Report

SMARTFIND may provide an informational Rental Trust Report or Alternative Trust Report based on information you provide and, where applicable, automated checks or document analysis.

This report:

  • is not SCHUFA;
  • is not an official credit report;
  • is not a legal guarantee;
  • is not a financial guarantee;
  • is not a guarantor service;
  • does not prove creditworthiness in an official legal sense;
  • does not guarantee landlord approval;
  • may not be accepted by landlords, agencies, platforms, or third parties.

You must not present any SMARTFIND report as an official SCHUFA report, official credit report, legal guarantee, bank guarantee, or government-issued document.

6. User Information

You may provide information such as:

  • name;
  • email address;
  • contact details;
  • city of search;
  • rental budget;
  • employment status;
  • approximate income;
  • document availability;
  • SCHUFA status or absence of SCHUFA;
  • visa or residence status;
  • uploaded documents;
  • other information needed to use the Service.

You confirm that the information you provide is accurate, lawful, current, and either belongs to you or is provided with proper authorization.

You must not upload documents or personal data of another person without a valid legal basis and their permission.

7. User Responsibilities

You agree not to:

  • provide false, forged, misleading, or fraudulent information;
  • use SMARTFIND to mislead landlords, agencies, platforms, or third parties;
  • present SMARTFIND reports as official credit reports;
  • alter reports or documents in a misleading way;
  • use the Service for illegal purposes;
  • copy, scrape, resell, or redistribute SMARTFIND content without permission;
  • interfere with the website, app, bot, systems, or infrastructure;
  • use the Service for discrimination, harassment, unlawful profiling, or unfair treatment of others.

8. AI Features

SMARTFIND may use artificial intelligence and automated systems to generate recommendations, summaries, texts, scores, and reports.

AI outputs may be incomplete, inaccurate, outdated, or not suitable for your individual situation.

You should review and verify all AI-generated content before using it.

SMARTFIND does not make automated decisions that create legal effects for users, such as official credit decisions, housing approvals, or legal eligibility determinations.

9. Paid Services and Subscriptions

SMARTFIND does not guarantee that you will receive a viewing, approval, offer, rental contract, or apartment.

12. Limitation of Liability

  • inaccurate third-party listings;
  • failed applications;
  • loss of rental opportunities;
  • AI errors;

  • indirect, incidental, special, consequential, or punitive damages.

If applicable law does not allow full exclusion of liability, SMARTFIND’s liability is limited to the amount you paid for the relevant Service during the three months before the claim, unless mandatory law requires otherwise.
